1. Acceptance of Terms

By registering for or using Bingwa Fantasy, operated by Hekima Labs SL ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service. We may update these terms from time to time and continued use constitutes acceptance of any changes.

2. Nature of the Service

Bingwa Fantasy is a free-to-play fantasy football game based on the Kenya Premier League (KPL). Users select virtual squads of real KPL players and earn points based on the actual statistical performance of those players in real matches. Rankings and prizes are determined entirely by participant skill and sporting knowledge. The Service does not involve betting, staking, or any form of wagering. No entry fee is required to play. Optional premium subscriptions offer additional game features but are not required to compete or win prizes.

3. Eligibility

• •You must be at least 18 years old to use the Service.
• •You must have a valid Kenyan mobile phone number (+254).
• •You must provide accurate information during registration.
• •One account per person. Multiple accounts will be suspended.

4. How It Works

You select a squad of 11 KPL players within a virtual budget. Your squad persists all season. Points are awarded per match based on real statistics (goals, clean sheets, etc.). Your captain earns double points. Each week (Monday–Sunday), the top-ranked managers win cash prizes paid via M-Pesa. Season prizes are awarded at the end of the KPL season to the highest-ranked managers overall.

5. Subscriptions & Payments

Bingwa Basic is free and gives full access to play and win prizes. Optional paid subscriptions (Pro, Elite) provide additional game features such as extra transfers and Boost Captain chips. Subscriptions are billed monthly via M-Pesa and can be cancelled at any time. Subscription fees are non-refundable. Subscriptions do not constitute bets or wagers.

6. Prizes

Weekly and seasonal cash prizes are awarded to top-performing managers based on skill and sporting analysis. Prizes are paid via M-Pesa to the phone number associated with your account. Prize amounts are published on the Service and may change at our discretion. Prizes are promotional awards for demonstrated skill, not gambling winnings.

7. Fair Play & Conduct

• •You may not create multiple accounts or use bots/automation.
• •You may not collude with other users to manipulate rankings.
• •You may not exploit bugs or technical vulnerabilities.
• •Violation of these rules may result in account suspension and forfeiture of prizes.

8. Privacy & Data

We collect your name, phone number, and game activity to provide the Service. We do not sell your personal data to third parties. Your phone number is used for account verification and M-Pesa prize payments. You can request deletion of your account and data at any time by contacting support.

9. Limitation of Liability

The Service is provided "as is" without warranties. We are not liable for interruptions, data loss, or errors in point calculations. We reserve the right to modify, suspend, or discontinue the Service at any time. In no event shall our liability exceed the amount you have paid for subscriptions in the prior 12 months.

10. Regulatory Compliance

Bingwa Fantasy is a skill-based fantasy sports platform. It does not meet the legal definition of gambling, betting, or lottery under Kenyan law (Betting, Lotteries and Gaming Act, Cap 131) because: (a) no money is staked or wagered by participants; (b) outcomes are determined by participant skill and sporting knowledge, not chance; (c) the basic service is free to play. This Service is not licensed by or affiliated with the Betting Control and Licensing Board (BCLB) as it does not constitute a regulated gambling activity.
